1. Introduction
This Returns and Refund Policy is drafted in accordance with the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”), which together govern your rights as an online consumer in South Africa. By purchasing from Agile Infinity (www.agileinfinity.co.za), you agree to the terms set out below.
2. Your Legal Right to Return Goods
As an online retailer, Agile Infinity acknowledges the following statutory rights of return:
2.1 ECT Act — 7-Day Cooling-Off Period
In accordance with Section 44 of the ECT Act, you have the right to cancel any purchase made through our website within 7 (seven) days of receiving your order, without providing any reason. To exercise this right:
- You must notify us in writing within 7 days of delivery via email at info@agileinfinity.co.za
- Goods must be returned in their original, unworn condition with all original packaging and tags intact
- You are responsible for the cost of return shipping where the goods are not defective
- We will process your refund within 30 days of receiving the returned goods
2.2 CPA — 6-Month Implied Warranty (Defective Goods)
In terms of Section 56 of the CPA, all goods sold by Agile Infinity carry a 6 (six) month implied warranty from the date of delivery. If your item is found to be:
- Defective or of poor quality
- Unsafe or not fit for its intended purpose
- Not as described on our website
You may return the goods at our cost and risk and elect one of the following remedies:
- A full refund of the purchase price
- A replacement of the same or equivalent product
- Repair of the defective item
If we repair an item and the same or another defect appears within 3 months of the repair, we will replace or refund — a second repair will not be offered.
2.3 Goods Not Pre-Inspected Before Purchase
As our store operates exclusively online, all goods are purchased without prior physical inspection. Upon delivery, you have the right to inspect your goods. If the product does not conform to what was described, advertised, or ordered, you may refuse delivery and request a full refund at no cost to you.
3. Our Store Exchange & Return Policy (Goodwill Returns)
In addition to your statutory rights above, Agile Infinity offers the following goodwill returns policy:

Please note: We do not offer refunds for change-of-mind purchases beyond our 7-day goodwill window. The CPA does not create a general right of return for change of mind.
4. Items That Cannot Be Returned
The following items are excluded from our goodwill returns policy (statutory rights still apply where relevant):
- Items that have been worn, used, or washed
- Items with tags removed or packaging damaged by the customer
- Items purchased during a final clearance or “no returns” sale (clearly marked at purchase)
- Socks and inner soles (for hygiene reasons)
5. How to Initiate a Return
- Email us at info@agileinfinity.co.za with your order number, reason for return, and photos of the item if defective
- We will respond within 2 business days with return instructions
- Pack the item securely in its original packaging with all accessories and tags
- Ship the item to the address provided (or we will arrange collection for defective items)
- Once received and inspected, we will process your refund or exchange within 5–7 business days
6. Refund Method
Refunds will be processed to the original payment method used at the time of purchase. You cannot be compelled to accept a store credit voucher if you are entitled to a cash refund under the CPA.
7. Delivery Costs
- If the return is due to a defective, unsafe, or incorrectly supplied item — Agile Infinity covers all return shipping costs
- If the return is a goodwill or change-of-mind return — the customer is responsible for return shipping costs
