1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Agile Infinity website (www.agileinfinity.co.za) and any purchases made through it. By accessing our website or placing an order, you agree to be bound by these Terms.

These Terms are drafted in compliance with:

  • The Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”)
  • The Protection of Personal Information Act 4 of 2013 (“POPIA”)

We sell sneakers, leather wallets, ladies’ purses, bags, and related accessories online to customers across South Africa.

3. Eligibility

By using this website, you confirm that:

  • You are at least 18 years of age, or have the consent of a parent or legal guardian
  • You are legally capable of entering into a binding agreement
  • You are purchasing goods for personal, non-commercial use (unless otherwise agreed)

4. Product Information & Pricing

  • All prices displayed on our website are in South African Rand (ZAR) and include VAT where applicable
  • We make every effort to ensure product descriptions, images, and prices are accurate. However, we reserve the right to correct any errors prior to order confirmation
  • Product images are for illustrative purposes — slight colour variations may occur due to screen display settings
  • We reserve the right to change prices without prior notice, but any price change will not affect an order already confirmed

5. Placing an Order

When you place an order on www.agileinfinity.co.za:

  1. You will receive an order confirmation email — this is acknowledgement of your order, not acceptance
  2. Your order is confirmed and accepted when we send a dispatch/shipping confirmation email
  3. We reserve the right to refuse or cancel any order at our discretion (for example, in cases of stock unavailability, suspected fraud, or pricing errors)
  4. If we cancel your order, you will receive a full refund within 15 business days

In accordance with the ECT Act, you have the right to cancel your order within 7 days of delivery without providing a reason. See our Returns Policy for details.

6. Payment

We accept the following payment methods:

  • Yoco Payment Gateways
  • Other methods as indicated at checkout

All payments are processed securely. Agile Infinity does not store your card or banking details. By submitting payment, you confirm that you are authorised to use the selected payment method.

7. Delivery

  • We deliver throughout South Africa
  • Estimated delivery times will be displayed at checkout and in your order confirmation email
  • In accordance with the ECT Act, we will deliver within 30 days of order placement unless an alternative timeframe has been agreed
  • Risk of loss or damage to goods passes to you upon delivery
  • If delivery is delayed or fails, you may cancel the order and receive a full refund within 15 business days
  • Agile Infinity is not liable for delays caused by courier companies or circumstances beyond our control (force majeure)

8. Product Authenticity

Agile Infinity sells authentic, genuine products only. All sneakers, wallets, purses, bags, and accessories sold on our website are sourced from authorised suppliers or distributors. We do not knowingly sell counterfeit goods. Any concerns about authenticity should be reported to us immediately at info@agileinfinity.co.za.

9. Intellectual Property

All content on www.agileinfinity.co.za, including but not limited to text, images, logos, graphics, and product descriptions, is the intellectual property of Agile Infinity or its licensors and is protected by applicable South African and international intellectual property laws. You may not reproduce, distribute, or use any content from this website without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by South African law:

  • Agile Infinity’s total liability to you for any claim arising from the use of our website or purchase of our products shall not exceed the purchase price of the relevant goods
  • We are not liable for any indirect, consequential, or incidental loss
  • Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or any liability that cannot be excluded by law, including under the CPA

If you have a complaint:

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our website following any changes constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms without affecting the validity of the remaining provisions.
